Pergola and Awning Permit

Pergolas are open structures made of lightweight materials, which can be covered with fabric, and are constructed without altering the structure of areas such as balconies, terraces, gardens, and communal living spaces. According to zoning regulations, pergolas and similar structures are not subject to building permits. This regulation is legally accepted. These structures can be built without requiring any permits.

The building regulations, under the heading "Structures not requiring a building permit, " specify that permits are not necessary for constructions such as retractable glass doors, foldable structures, simple repairs and alterations, glass panels, railings, pergolas , gazebos, and similar renovations and installations. The only illegal construction is completely enclosing balconies or terraces to create a room. Approval from the relevant authorities is required for such actions. 

The materials used in pergola construction must be lightweight. The reasons for using lightweight materials include ensuring the main support structure is not affected and eliminating the need for additional construction space. There should be no space gain. The purpose of pergolas and similar structures is crucial in determining whether they require a permit. The intended use must not be for protection from rain or sun; it must be an open area and not used as an enclosed space. 

The choice of materials and construction method for pergola construction is as important as the location where the pergola will be built. Large metropolitan cities, in particular, often have many multi-story buildings. This leads to shared spaces and adherence to specific regulations. Whether the structure will encroach upon private space is also a determining factor in obtaining a permit. According to regulations, permits are required for the construction of pergolas and similar structures on balconies, which are the only open space in multi-story buildings. However, in low-rise or detached buildings, where the open space is greater, a permit is not required for pergolas built on balconies. 

According to the regulations, for a building to be considered exempt from licensing requirements;

  • It must be done within the framework of the established rules.
  • Not creating an enclosed space
  • It is open on all sides and used solely for shading purposes
  • It must not damage the load-bearing system
  • It should serve no purpose other than protection from sun and rainwater.
